Terms of Service

1. Introduction
PilotCast.ai is operated by A Prompt PC. These Terms of Service ("Terms") govern your use of all PilotCast services, including:
- PilotCast Business Services — AI agents for businesses (Starter, Growth, Pro, and Enterprise tiers)
- PilotCast Personal Services — personal AI companions for individuals (Personal and Personal Pro tiers)
By creating an account, subscribing, or using any PilotCast service, you agree to these Terms. If you do not agree, do not use the service.

2. Definitions
- "Business Services" — AI agents created through PilotCast for commercial use, including livestreaming, website embedding, and audience engagement. Tiers: Starter ($149/mo), Growth ($399/mo), Pro ($899/mo), Enterprise ($3,000+/mo).
- "Personal Services" — private AI companions created through PilotCast for individual, non-commercial use. Tiers: Personal ($9.99/mo), Personal Pro ($49.99/mo).
- "Host" or "Agent" — the AI personality created and configured through the PilotCast platform.
- "You" or "User" — the person or entity using PilotCast services.
- "Client" — a business-tier user who operates an AI agent for commercial purposes.
- "Platform" — the PilotCast software, APIs, web interfaces, and infrastructure.
3. Account & Billing ALL TIERS
PilotCast subscriptions are billed monthly or annually via Stripe.
- Annual plans include a discount equivalent to 2 months free (pay for 10 months, receive 12)
- Free trial: Business tiers receive a 14-day trial; Personal tiers receive a 7-day trial (unless otherwise specified per-client)
- You may cancel at any time. Your service remains active until the end of the current billing period
- No refunds are issued for partial months or unused portions of a billing period
- Price changes will be communicated with at least 30 days notice via email
- Custom pricing agreements (negotiated rates, introductory offers) are documented per-client and take precedence over published rates
Your tier determines available features. Your price may differ from published rates if a custom arrangement has been agreed upon.
4. Personal AI Services PERSONAL TIERS
This section applies to Personal ($9.99/mo) and Personal Pro ($49.99/mo) tiers.
Permitted Use
- Personal AI companions are for personal, non-commercial use only
- You may not use a personal AI to interact with customers, embed on websites, operate as a business tool, or serve any commercial purpose
- Commercial use requires an upgrade to a Business tier
Conversation Memory
- Personal tier: 90-day conversation memory
- Personal Pro tier: Permanent conversation memory (retained for the life of the subscription)
Bring Your Own Key (BYOK) — Personal Pro Only
- Personal Pro users may connect their own API key from supported providers (OpenRouter, OpenAI, Anthropic, Google, and others)
- You are responsible for your own API key costs and compliance with your API provider's terms of service
- A 10% platform fee is applied to BYOK usage for infrastructure and processing costs
- If no BYOK key is provided, PilotCast's included LLM is used (subject to monthly limits)
5. Business Services BUSINESS TIERS
This section applies to Starter ($149/mo), Growth ($399/mo), Pro ($899/mo), and Enterprise ($3,000+/mo) tiers.
Commercial Use
- Commercial use is permitted within the scope and limits of your selected tier
- You are responsible for the accuracy of your agent's education content and knowledge base
- You are responsible for compliance with industry regulations applicable to your agent's niche (healthcare disclaimers, financial disclaimers, etc.)
- PilotCast provides the platform — not professional advice. Your agent is not a licensed professional
Portal & Chat Visibility
- Portal access is confidential to the account holder
- Chat visibility settings (public/private) are the client's responsibility to configure appropriately for their industry and audience
Commitment Period
Some business subscriptions include a minimum commitment period as agreed during onboarding. During the commitment period, cancellation may result in the remaining balance being due. After the commitment period, subscriptions continue month-to-month. If no commitment was agreed upon, the subscription is month-to-month from the start.
6. Content & Conduct ALL TIERS
You agree not to use PilotCast to:
- Generate or distribute content promoting violence, self-harm, illegal activity, or exploitation
- Produce hate speech, harassment, or discriminatory content
- Impersonate real individuals without their consent
- Distribute malware, spam, phishing, or deceptive content
- Violate any applicable laws or third-party rights
- Circumvent platform terms of service (YouTube, Twitch, etc.)
- Use automated, scripted, or bot-driven methods to abuse the service
You may customize your AI's personality within these boundaries. PilotCast reserves the right to suspend or terminate accounts that violate these terms or circumvent safety guidelines.
Fair use limits apply per tier. Exceeding your tier's monthly limits may result in temporary throttling until the next billing cycle.
7. AI Limitations & Disclaimers ALL TIERS
PilotCast AI is not a licensed professional. It is not a therapist, doctor, lawyer, financial advisor, or any other regulated professional.
- AI-generated content is for informational and entertainment purposes only
- AI is not a substitute for professional help, medical advice, legal counsel, or financial guidance
- PilotCast is not liable for decisions made based on AI-generated output
- Business clients are responsible for monitoring their agent's output and ensuring compliance with industry standards

8. Healthy AI Use ALL TIERS
PilotCast is committed to healthy AI practices.
- Our AI will never guilt users for not engaging or pressure continued use
- We provide usage analytics and weekly digests to promote self-awareness about AI interaction patterns
- We encourage users to maintain real human connections alongside AI interaction
- Personal AI companion features are designed for personal growth, not dependency
- We build tools that make you better at using AI — not addicted to it
9. Data & Privacy ALL TIERS
What We Store
- Configuration: Agent settings, personality, education content, theme preferences
- Conversations: Records of interactions (for memory, analytics, and personality development)
- Assets: Avatar images, videos, and branding materials you upload
- Metrics: Usage data (LLM calls, TTS characters, visit counts) for billing and analytics
Privacy
- Conversations are private by default
- We do not sell, share, or use conversations to train third-party AI models
- Streaming credentials (API keys, stream keys) are stored encrypted and never exposed through any API or dashboard
- Business clients: portal conversations (business intelligence) are visible only to the account holder and platform admin
Data Retention
- Active subscription: data is stored per your tier's limits
- After cancellation: data is preserved for 90 days, then permanently deleted
- Data export is available on request (Pro+ business tiers and Personal Pro)
- Right to deletion honored within 30 days of request
10. Intellectual Property ALL TIERS
- The PilotCast engine, branding, platform code, and infrastructure are the intellectual property of A Prompt PC
- Content you create through the platform (personality configurations, education content, avatar uploads, conversation history) belongs to you
- "Powered by PilotCast AI" branding is displayed per your tier agreement. Branding removal is available at Pro tier and above (business) or included in Personal tiers
11. Service Level ALL TIERS
- PilotCast operates on a best-effort basis. We strive for high availability but do not guarantee a specific uptime percentage for non-Enterprise tiers
- Enterprise clients may negotiate a Service Level Agreement (SLA) with defined uptime guarantees
- PilotCast may modify features with reasonable notice
- PilotCast reserves the right to discontinue the service with 30 days notice and a data export opportunity
12. Age Requirement ALL TIERS
You must be 18 years of age or older to use PilotCast services. PilotCast does not knowingly provide services to minors. If we become aware that a user is under 18, we will terminate the account and delete associated data.
13. Termination ALL TIERS
- Either party may terminate at any time
- Cancel through the billing portal, your dashboard, or by contacting Kyle@PilotCast.ai
- Your service remains active until the end of the current billing period
- Violation of these terms may result in immediate suspension without refund
- Data is retained for 90 days post-cancellation, then permanently deleted
- To reactivate within the 90-day window, contact us and your account can be restored
14. Changes to Terms
PilotCast may update these Terms at any time. The current version is always available at pilotcast.ai/terms.
- Material changes will be communicated with at least 30 days notice via email to active subscribers
- Continued use of the service after changes constitutes acceptance of the updated Terms
15. Governing Law
These Terms are governed by the laws of the State of Georgia, United States. Any disputes arising from these Terms or your use of PilotCast services shall be resolved in the courts of Walton County, Georgia.
